Separate sealed BIDS for the construction of the Taos Valley Regional Wastewater Treatment Facility MBR Upgrade will be received by the Town of Taos at the office of Ms. Tina Torres, Procurement Officer, Town of Taos, Finance Department, 400 Camino de la Placita, Taos, New Mexico 87571 until 2 p.m. (Local Time), January 13, 2009, at which time the bids will be open at the Town of Taos Municipal Building (Town Hall), Room 109, 400 Camino de la Placita, Taos, New Mexico 87571.

Project Description: This project consists of expansion and upgrade of Town of Taos wastewater treatment facility, 2.4mgd capacity with membrane technology, including installation of solar power infrastructure and construction of new treatment plant building.

Any contract or contracts awarded under this invitation for bids are expected to be funded in part by a grant from the United States Environmental Protection Agency (EPA) and therefore must comply with all federal cross cutter requirements. Neither the United States nor any of its departments, agencies or employees is or will be a party to this invitation for bids or any resulting contract. This procurement will be subject to regulations and requirements of the Davis-Bacon and Related Acts and the Buy American Provisions of the American Recovery and Reinvestment Act.

The Procurement Code, Section 13-1-28 through 13-1-199 NMSA 1978, imposes civil and misdemeanor criminal penalties for its violation. In addition, the New Mexico criminal statutes impose felony penalties for bribes, gratuities and kick-backs.

The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.

In order to be in compliance with applicable Federal Statutes, Authorities and President's Executive Orders, Bidders' and Contractors' Certifications and Acknowledgments are required. A list of suggested forms for certifications and acknowledgments are in the EPA Region 6 Supplemental Conditions for Federally Assisted Wastewater Infrastructure (Pink Sheets) in the specifications.

Copies of the CONTRACT DOCUMENTS may be obtained at the office of the ENGINEER, Souder, Miller & Associates, 1201 Parkway Drive, Santa Fe, New Mexico 87507, upon payment of $250.00 for each set. Any BIDDER, upon returning the CONTRACT DOCUMENTS in good condition within 30 days of bid opening, will be refunded $250.00.

A MANDATORY PRE-BID MEETING will be held at the Public Works Department Conference Room, at 1030 Dea Lane, Taos, NM 87571 on December 17, 2009 at 10 a.m. Any BID presented by a BIDDER who did not attend the Mandatory Pre-Bid Meeting will not be considered.

As per NMSA 1978 Sections 13-1-131 and 13-1-132, the Town of Taos reserves the right to cancel this procurement or reject any/all bid proposals if it is in the best interests of the Town to do so and to waive all technical irregularities not involving price, time or changes in work.
