Separate sealed BIDS for the construction of the Eastern Navajo Water Pipeline Phase 3 Project will be received by the OWNER at the office of the ENGINEER, Souder, Miller & Associates, Attention: Andrew Robertson, P.E until 2:00 p.m. (Local Time), Tuesday, February 21, 2012, and then at said office publicly opened and read aloud.

Project Description: This project consists of approximately 17.5 miles of 24-inch, 22-inch, and 8-inch HDPE water transmission pipeline spanning from the Huerfano to Nageezi Chapter of the Navajo Nation. Includes 100,000 gallon water storage tank, booster pump station, two chlorinators, and surge tank building.

Copies of the CONTRACT DOCUMENTS may be obtained at the office of the ENGINEER, Souder, Miller & Associates, 3451 Candelaria Rd. NE, Ste D, Albuquerque, NM 87107, upon payment of $300.00 by check only, for each set. Any BIDDER, upon returning the CONTRACT DOCUMENTS in good and complete condition within 30 days of bid opening, will be refunded $300.00.

A MANDATORY PRE-BID MEETING will be held at the Nageezi Chapter House, 11553 (Mile Marker 115), U.S. 550, Nageezi, New Mexico, on Tuesday, January 31, 2012 at 11:00 a.m.

The PROJECT is located in Nageezi and Huerfano, San Juan County, New Mexico.

Five percent preference will be given in award to Navajo and other Indian-owned firms qualifying for preference in accordance with the Navajo Nation Business Opportunities Act, N.N.C. Title 5, Chapter 2. Bidders claiming preference shall submit evidence of their priority certification with their bid. Suppliers, brokers, agents, subsidiaries, successors and assigns shall be fully subject to the requirements and provisions of the Navajo Nation Business Opportunity Act (“the Act”). Those firms seeking preference priority under this solicitation must document with their bid that any third parties delivering goods and services pursuant to this solicitation were selected according to the procedures described in the Act. Failure to comply with this requirement will result in the bid being declared non-responsive and being rejected. All firms submitting bids under this solicitation must comply with all other qualification requirements referenced in the solicitation documents in order for their bid to be considered responsive.

Five percent resident (New Mexico) contractor preference shall also apply to this Project per Section 13-1-21 NMSA 1978, as amended during the First Special Legislative Session of 2011.

3.06 Electronic Data
  1. For the present Project, Bidding Documents in electronic media format are furnished to bidding contractors for the sole purpose of preparing bids, and not for construction. The selected construction Contractor shall not rely on files provided in electronic media format for construction but rather hard copies of such data provided by the Engineer or Owner upon award of the Contract.
  1. Because Data stored in electronic media format can deteriorate or be modified inadvertantly or otherwise without authorization of the data’s creator, the party receiving electronic files agrees that it will perform acceptance tests or procedures within 60 days, after which the receiving party shall be deemed to have accepted the data thus transferred. Any errors detected within the 60-day acceptance period will be corrected by the transferring party.
  1. When transferring documents in electronic media format, the transferring party makes no representations as to long term compatibility, usability, or readability of documents resulting from the use of software application packages, operating systems, or computer hardware differing from those used by the data’s creator.
